In a world of sectarian violence, what can be done?

By Charles C. Haynes

Last week, the Islamic State of Iraq and Syria – the extremist movement now occupying large swaths of territory in the region – forced the last Christians out of the Iraqi city of Mosul.

Images of desecrated churches, looted homes and ruined lives now serve as the obituary for one of the world’s oldest Christian communities.

If the world barely noticed, it’s not surprising. The fate of Christians in Mosul is only one of many competing news stories of religious and ethnic violence across the globe, from northern Africa to the Middle East to Ukraine.

Tragically, people in many parts of the world …read more

Examining the new importance of ‘where’ we speak

By Gene Policinski

When we say something that might be threatening, how much does where we say it matter?

The U.S. Supreme Court agreed in June to examine that question from a new angle – the increasingly popular method of online comments and posts on social media, as distinct from directed or face-to-face exchanges.

The First Amendment generally shields us from being punished for what we say, but there are exceptions, among them what is called a “true threat.”

Courts have used two approaches in dealing with threats. One requires police and prosecutors to show that the person making the threat genuinely intended harm. The other …read more

Beyond the outrage, is Hobby Lobby decision a win-win?

By Charles C. Haynes

Outrage over the Supreme Court’s decision in the Hobby Lobby case reached fever pitch this week as congressional Democrats prepared to introduce legislation to reverse the ruling.

“Your health care decisions are not your boss’s business,” Senator Patty Murray, D-Wash., told The New York Times. “Since the Supreme Court decided it will not protect women’s access to health care, I will.”

Of course, any attempt to reverse Hobby Lobby will fail in the House of Representatives. So Democrats are looking to the midterm elections – already sending fundraising appeals headlined “Supreme Court decides that corporate rights trump women’s rights.”

Before going off that …read more

A positive Supreme Court term for the First Amendment

By First Amendment Center

By Megan Chester & Brian Palumbo
Newseum Institute’s First Amendment Center

The Roberts Court has proven to be a champion of the First Amendment, ruling in favor of First Amendment protections in the majority of 10 First Amendment cases before the U.S. Supreme Court during the term that began in October 2013 and ended in June. Yet, increasingly narrow holdings and exceptions for national security purposes, and a continuation of decisions supporting certain First Amendment rights for corporations, lead some observers to question in what direction the Court’s First Amendment jurisprudence will go.

Two First Amendment cases in which the Court denied …read more

Telling the police to f*** off: risky First Amendment business

By First Amendment Center

By Clay Calvert
Contributing columnist

Editor’s note: This column first appeared in the Huffington Post.

“Fuck the fucking cops they ant shit but fucking racist basturds.”

Regardless of whether those “basturds” are inglorious or otherwise, who among us hasn’t wanted, at one time or another, to utter similar stinging sentiments, perhaps in a hasty fit of rage or simply after getting pulled over in a speed trap? Even putative American princess and erstwhile sweetheart Reese Witherspoon has told off the police, rendering her illegally blonde.

Although perhaps not artfully or eloquently phrased, the sentiments about the cops harbored by …read more

John Seigenthaler: A champion of the First Amendment

By Ken Paulson

A lead pipe to the head will get your attention.

One day in 1961, Justice Department aide John Seigenthaler was brutally attacked with a pipe by Ku Klux Klansmen as he rushed to protect Freedom Riders arriving in Montgomery, Ala. The Klansmen left John in the street to die.

But John survived, going on to a rich career as a journalist and a passionate First Amendment advocate who would laugh about how Attorney General Bobby Kennedy thanked him for “using his head.” John died at 86 Friday morning in Nashville.

That blow to the head inspired self-deprecating jokes throughout his career, but it …read more

Duff: We have lost ‘a champion for freedom’

By First Amendment Center

By James C. Duff

We are deeply saddened to inform you that John Seigenthaler, our dear colleague and founder of our First Amendment Center, passed away today, resting peacefully at home with his family by his side.

John Seigenthaler was a gift to our country. His pledge of allegiance to the Republic was not routine recitation nor passive expression of sentiment. For John, it was a call to action. He devoted his life to making certain that liberty and justice for all applied to all. He thereby breathed life into our …read more
